One of the most charming designs for an emblem shows Cupid rashly pursuing the sweetness of the honeycomb only to be stung by the bees who have made it (Pl. XIII), a poignant allegory of the pleasure and pain of love. The Netherlandish hat badge in Plate IX is an emblem depicting a woman choosing between two suitors surrounded by a motto that can be translated “love is something but money is everything.”

Our capital markets/CMBS lenders were active, our local banking community was competitive and actually experiencing a healthy increase in market value; money continued to chase deals (albeit a little more cautiously) and supply seemed to out-strip demand. Although no one knows for sure how these events will affect the real estate finance market over the long run, we are hopeful that our lending community will continue to act objectively with prudence as they evaluate and underwrite our loan applications. Indeed, I can tell you that the lenders Ive spoken with during the weeks following the attack generally believe that the New York real estate market possesses a strong fundamental foundation and demand for commercial space as well as ownership and rental apartments will continue under normal market conditions. Contrary to what one might expect during such times of uncertainty, no lending source has developed a doomsday attitude towards real estate. In fact, several lenders actually see the potential for a stronger market to emerge with isolated positive opportunities. Suddenly there is a huge demand for more office space, more construction services, more desks, phones, computers etc. The flip side is, of course, that tourism will be down in the near term, food services will suffer, entertainment dollars will go elsewhere and more people may stay at home and restrain their spending habits.
New withholding requirements recently enacted by the state affect all individuals who sell California real property. Beginning Jan. 1, escrow companies must withhold 3-1/3 percent of the sales price of any real estate sold that is more than $100,000, not a personal residence, and not a 1031 exchange, 1033 involuntary conversion or a foreclosure. The only exception to the withholding requirement is if the seller signs under penalty of perjury that there is a loss on the sale.

Second, attachment (i.e., creation) of a security interest8 in Article 9 collateral, including a promissory note, requires either (1) a security agreement authenticated by the debtor, or (2) possession of the collateral by the secured party pursuant to an agreement.9

Kitchen remodeling for wheelchair independence and convenience The absence of steps indoors and few elevation changes outdoors was what attracted Barbara Allan to this 1950s ranch-style house in North Seattle. But its succession of small rooms with narrow doors made wheelchair maneuvering tricky. Remodeling the kitchen was the most pressing need. “I want something esthetically pleasing and not too different-looking, but convenient for me,” Ms. Allan told architect Carolyn Geise. By enlarging doorways and windows and adding a new sunroom as transition space between house and garden, Geises remodel made the entire house seem lighter and larger, as well as less inhibiting for its owner. But the most impressive changes were in the kitchen. Lower-than-average counters, toe spaces that are high and deep For anyone using a wheelchair, its essential that rooms have at least a 5- by 5-foot open space so the chair can be turned. To accomplish this, the remodel incorporated space from what had been a separate dining area. Now the kitchen is arranged along three walls; the stove lines up with a kneehole sink. At 33 inches high, most counters in this kitchen are a few inches lower than standard height (the dishwasher is under a regular 36-inch counter). Toe space under all cabinets is an extra-generous 7 1/2 inches high and 8 1/2 inches deep. Next to the ovens, a baking center-pantry can be closed off by doors that slide back into the walls. Open, it has a sturdy pullout maple board at the right height for mixing up a cake or rolling out biscuits. Pots, pans, and some dishes are stored in drawers below the counter. Adjoining the pantry is a built-in wall oven with a microwave underneath. The built-in 47-inch-diameter dining table is 27 inches high. With only a center pedestal, its easy to roll up to. The only space added during the remodel is a 6 1/2- by 12-foot sunroom with double glass doors that slide open to the garden. LEED version 2.2, released last October, is the first national specification to use a relatively new measure of reporting a cool roofs properties. LEED 2.2 sustainable sites credit 7.2 states that to receive one point, building owners should use a roof with a Solar Reflective Index (SRI) of 78 over at least 75 percent of the roofs surface for roofs with slopes less than 2:12. The new twist is SRI, a unit developed by scientists at Lawrence Berkeley National Laboratory. SRI incorporates reflectivity and emissivity properties into one, easy-to-read, standardized measure so that roof buyers wont have to scratch their heads and try to figure out if a high reflectivity and low emissivity is better or worse than a medium reflectivity and high emissivity. SRI is calculated with a complex formula spelled out in ASTM E1980 and is a scale of 1 to 100 that is a measure of a roofs combined thermal properties. It is defined so that a standard black (reflectance 0.05, emittance 0.90) is 0 and a standard white (reflectance 0.80, emittance 0.90) is 100. But some hot roofs can have negative values, and some white thermoplastics and white roof coatings have scored as high as 104 to 110.

Begun millennia ago, taxation developed as a method of exploitation. Instead of massacring defeated peoples, or taking them as slaves, conquerors realized that they could make a regular income by demanding wealth–with the threat of massacre as a prod. Of course the methods of taxation have been refined since those early days, but they still rest on the ugly foundation of force and the threat of force.Yet philosophers and idealists, so eager to liberate the human race in other ways, have all but ignored taxation. Our cultures two outstanding thoughts on the subject are Benjamin Franklins aphorism that “nothing is certain but death and taxes,” and Supreme Court Justice Oliver Wendell Holmess dictum that “taxes are what we pay for civilization.” In other words, either you simply cant do away with taxes, or if you did, civilization would collapse. In the thrall of this received wisdom, generations of earnest reformers have accepted taxation, the legacy of Roman tyrants, as the only workable way to raise money for public purposes.There are signs that this intellectual free ride is coming to an end. Sophisticated new research has begun to document what common sense long suggested, namely that taxation, far from being an efficient money machine, is an extremely wasteful way to raise money.

IHS dentists provide clinical services in 200 dental clinics in IHS/tribal hospitals or ambulatory health centers in 33 states. Within the FBoP, inmates receive dental treatment at 107 dental clinics. Of the 509 dentists who were mailed the questionnaire, 489 (96% [372 IHS and 117 FBoP]) responded. Of the 489, 194 (40%) dentists had practiced clinical dentistry in the IHS or FBoP for lt;3 years; 183 (37%), 3-9 years; and 112 (23%), [equal to or greater than] 10 years. The mean years of clinical practice were similar for dentists in both groups (5.9 years for IHS and 5,6 years for FBoP dentists; p=0.7, two-tailed t-test); 438 (90%) reported that they were practicing clinical dentistry at the time of the survey (87% IHS and 97% FBoP), and the remainder were in nonclinical positions. Almost all (474 [97%]) respondents reported ever having received a TST (365 [98%] IHS and 109 [93%] FBoP); 92% of those tested reported always having a negative test result (Table 1). Of 36 dentists who reported ever having a reactive TST, 17 (47%) reported the first reactive TST occurred after graduation from dental school. Of these 17 dentists, 14 (11 IHS and three FBoP) reported converting from a negative TST to a reactive TST.
The Directorate of Health Promotion and Wellness (DHPW) at the U.S. Army Center for Health Promotion and Preventive Medicine was established in 1995 with the mission of integrating health promotion into the total Army. A dentist was assigned to the DHPW staff in 1996 to help integrate health promotion into the Army Dental Care System (ADCS). To guide the development of DHPW products, services, and policy for the ADCS, DHPW conducted a survey of dental health promotion and preventive dentistry practices within the ADCS. The survey queried the frequency with which dentists deliver such services and the type and source of their patient educational materials. In this paper, we report the findings of that survey and discuss their implications for improving the delivery of dental health promotion and preventive dentistry services in the ADCS.

This is an exceedingly important book. it is probably the most important contribution to the Marxian theory of money, credit and finance to appear in English since the translation of Suzanne de Brunhoffs Marx on Money in 1976. Itoh and Lapavitsas book includes a wealth of information, superb literature reviews, profound analyses of the historical evidence and substantiated discussions of controversial policy issues, whose digestion will keep even the most demanding readers busy for a long time. Their argument is invariably thorough, and their research ranges widely, and admirably, from the logical and historical origins of money to free banking, and from long wave theories to socialist money. In spite of its virtues, and partly because of them, this book will probably not become an icon of the literature, although it will certainly become a major reference in the field (which may well be a better option). The reason is simple: Itoh and Lapavitsas probe very deeply into Marxs theory of money and credit, marshal evidence widely, and engage in a wide variety of debates, not least with Marx himself (eg., they criticise certain aspects of Marxs theory of money, on pp.37-40, and credit, on pp.64-5). As their work is very ambitious, complex and controversial, it is unlikely to be universally acclaimed.

For the emerging field of forex trading, time can only tell if new ideas of neural networks, chaos theory, fractals and computerized pattern recognition tools will become the classics for the conduct of future technical analysis. Before traders employ the latest technical indicator or signal generator, they should have a perspective on the classic technical analysis tools and techniques. What is a classic is debatable. For simplicitys sake, our demarcation line between classic and modern will be the widespread adaptation of computers. Before computers, indicators were developed based on the acute observation of price action and accumulated wisdom of traders. They can be considered classics because they also are robust and have persisted beyond the ebb and flow of fads in technical analysis. Classic tools have been proven in direct experience, not computer simulations.

For some reason I found myself thinking of the sad advertisements one used to see occasionally in the personal columns: “Public school man seeks interesting job, anything legal considered.” But of course I was confusing two different functions of the word legal. Ethical began by meaning “to do with ethics”, and only later came to mean being good. The purist in me still winces when someone says “aesthetic” when they mean “in good taste”. (Aesthetic originally meant “to do with the science of perception”, then “to do with taste”, good, bad or indifferent.) But there was never any need for legal to carry two meanings, because theres a perfectly good alternative that takes half the burden off it: lawful, a nice old word from the late Middle Ages (its parent word, law, appears to be of ancient Scandinavian origin). Everyone understands the difference between “legal business” and the “lawful business” that most of us spend our lives going about. Why couldnt those job-seekers have put “anything lawful considered”? Lawyers use lawful, too; they speak of a “lawful killing”. They dont say “a legal killing” (which, if it meant anything, would presumably refer to their fees).

If Cyprus is ever to be reunited, some way will have to be found that is not strictly along democratic lines. Democracy means majority rule, and the Greek Cypriots, as one could expect, are all for it, as are the Protestants of Northern Ireland and the blacks of South Africa. But the Turkish Cypriots, understandably, wont accept such a governing formula.

PhotographOne of the first researchers to produce photographic images using silver halide chemistry was Schultze. As early as 1727, he formed metallic silver images by first reacting solutions of silver nitrate and white chalk and then exposing these solutions to light through stencils. Schultzes work was improved upon through the efforts of Louis Jacques Mand#xE9; Daguerre who, in 1837, developed a process for printing images on a silver coated copper plate. This type of printed image, called a daguerreotype in honor of its primary inventor, is made by polishing and cleaning a silver-coated copper plate and then reacting the silver coating with iodine vapors to form light-sensitive silver iodide. The silver iodide coated plate is then exposed to light through the optics of a camera that projects and focuses an image on the plate. In the ensuing reaction, the silver ions are reduced to silver metal. Finally, the plate is treated with mercury to produce an amalgam. In this type of print, the areas of the plate exposed to light appear white and the unexposed areas remain dark. The problem with this method was that it required long exposure times because the intensity of the image depends solely on the strength of the light forming the image.
To come up with a different image no matter what it takes For the last twenty years, Milian has been bringing that edgy spirit of innovation to sports photography as a staff photographer at Sports Illustrated. He has mounted a remote-controlled camera on the front of a kayak-, dangled from helicopters, and spent a week in the Colombian jungle photographing a boxing dynasty. All the while, though, his work remained grounded in the basics of lighting and composition. He does mostly indoor work for SI, and his photos inevitably capture the defining moment of the action with studio-like quality and precision. Consider his preparation for a basketball game at Madison Square Garden: he arrives at one in the afternoon - five cases of equipment in tow - for a 7 Pm. tip-off. Depending on what hes after, he may set up eight or more cameras - on the catwalk, mounted behind the backboard glass, in the stands, and on the floor. Each is synchronized with his hand-held camera via a Flash Wizard, a radio-controlled device that allows him to get the same shot from multiple angles. Next, a set of strobe lights is set tip in each corner of the court, also synchronized like the cameras. most of srs indoor jobs are shot using strobes rather than natural light. They provide an intense, even light that allows Milian to use fine-grained film and produce higher quality images. The trade-off is that, while his newspaper counterparts using motor drives shoot five frames a second, Milian gets one image every three seconds. “It puts more of a premium on the focus of your assignment,” he says. “We cant just go in and fire away. We have to concentrate on getting the peak action on one shot.”

Others seek professional assistance, but they may not get the right kind of advice for their needs. “You go about selecting a financial planner like any other search for a professional,” says Patti Houlihan, a Virginia-based financial planner and former host of the Public Broascasting Services television series “The Financial Adviser.” Houlihan advises seeking referrals from friends, colleagues, and other professionals such as tax advisers or attorneys. “If you dont come up with any worthwhile prospect,” she says, “get some referrals froma an organization that represents financial planners.”

By emphasizing the lawyers place in the adversarial system, the 1969 code served a forceful unifying and educational function.4 Nevertheless, an ethics codes overemphasis on a single paradigm can lead to undesirable results. It tends to produce idealized rules that either rest on counter-factual assumptions or impose obligations on lawyers that are so inconsistent with their personal incentives that violations become routine. In modern times, an exclusive focus on the adversarial ethic seems less important than in 1969 because lawyers have developed a shared sense of core obligations to clients and of the part lawyers play in the legal system. The recent history of lawyer regulation reflects a desire on the part of the bar to fine-tune the basic message of the 1969 code-to recognize more nuances than, perhaps, a single image of lawyers can accommodate.5 The task of drafting professional rules is complicated by the fact that the public perception of the bar is not unitary. Society views lawyers in many different, and sometimes inconsistent, ways. These multiple conceptions influence code drafters. In practice, the modern legal ethics codes incorporate a number of “images” of lawyers as bases, or catalysts, for disciplinary rules. Relying on these images has consequences for how the codes treat lawyers and, as a theoretical matter, for how the rules should be drafted.
Last month I wrote about the Lawyers-Helping-Lawyers Committee as a resource for an impaired lawyer. I wrote about courage and compassion to oneself and to fellow attorneys to admit impairment and to seek recovery. Today I want to discuss the equally troubling and less pollyannaish facts of life — many impaired lawyers refuse assistance. When you have mustered the courage to confront a fellow attorney about an impairment, you have done so assuredly because you have become convinced that your friends impairment is destroying his life. You already know that that person must get help — voluntarily or involuntarily. You know that to allow them to continue impaired leads only to death and destruction. Death in a physical sense for the impaired lawyer through alcoholism, drug abuse or suicidal despair. Death for innocent people who die, for example, in auto accidents when your impaired friend gets behind the wheel. Destruction for the impaired lawyers family and loved ones who cannot continue living sane and dignified lives with the impaired person. Destruction for the impaired lawyers clients who do not receive the competent, diligent representation they deserve. As a matter of morality, you should act to save your friend and (indirectly) those around him — family, innocent people, clients. As a matter of self-protection, you must act because failure to act can lead to professional discipline. The Bar is a self-regulating profession. If you have knowledge of a lawyer or a judge impaired in their fitness for professional duties, Rules of Professional Conduct (RPC) Rule 8.3 mandates that you “shall inform the appropriate professional authority.” Failure to report when appropriate is itself a disciplinary violation. If you are a partner or a supervising lawyer, you are accountable under RPC Rule 5.1 for anothers ethical violations if you have failed to adopt the reasonable measures in your firm that assure compliance with ethical conduct. In addition, Rule 5.1 also imposes personal ethical responsibility upon you if you know of an impairment and fail to take reasonable remedial actions that can avoid or mitigate the consequences of anothers (the impaired lawyer) professional misconduct. As these violations of Rule 5.1 are your personal ethical obligations, you may also have malpractice liability for your failure to act to prevent harm, even though you have tried to insulate yourself by becoming a limited liability company or a limited liability partnership. Who is the appropriate professional authority to whom you must report an impaired lawyer? As I have already intimated, if the impaired lawyer is willing voluntarily to seek recovery and has not committed an ethics violation, the appropriate professional authority is the Lawyers- Helping-Lawyers Committee. You may refer the impaired lawyer willing to seek recovery to the L-H-L for the committees guidance, counseling and monitoring. As to the recalcitrant impaired lawyer, the appropriate professional authority is the general counsel of the Bar Association. The general counsel may invoke Rule 10 (suspension for personal incapacity to practice law) of the Rules Governing Disciplinary Proceedings (RGDP). Under Rule 10, the general counsel may initiate a proceeding to suspend the incapacitated lawyers license. If suspended, the Supreme Court will not return the lawyers license until the lawyer can prove, through reinstatement proceedings, that he once again has the personal capacity to practice law. Rule 10 means to protect clients and the public from an impaired lawyer. Rule 10 is not geared toward disciplining (punishing) a lawyer for an ethics violation. Consequently, Rule 10 is a confidential proceeding on a separate, non-public docket under the direct supervision of the chief justice. By contrast, if the impaired lawyer has already caused a harm to a client that violates the Rules of Professional Conduct, the appropriate professional authority is again the general counsel of the Oklahoma Bar Association. But now the general counsel invokes the usual disciplinary procedures in RGDP Rule 6. These disciplinary procedures are open to the public once the court clerk of the Supreme Court files the formal complaint and the respondent lawyers answer. When the general counsel becomes involved through either Rule 10 or Rule 6 in proceedings relating to an impaired attorney, the general counsel also invokes RGDP Rule 12 (winding up business of lawyer who is deceased, incapacitated or missing not pending disciplinary proceedings). Rule 12 is a relatively new rule, adopted in December 1996. Rule 12 authorizes the general counsel to exercise oversight appropriate to the circumstances to protect the impaired lawyers clients. Lawyers need courage and compassion about impairment for themselves and for fellow lawyers. Lawyers also need awareness of their ethical obligations to report impaired lawyers to the appropriate professional authority. Koji Ikeda, a first secretary, and his 5-year-old son Kotaro died while his 32-year-old wife Naomi suffered minor injuries in the accident, which took place on a highway linking Orleans and Paris, according to the ministry.
A man accused of causing a fatal accident on the Bangerter Highway last April pleaded guilty Tuesday to one count of automobile homicide. Finhas Habib, 37, appeared in 3rd District Court to enter his plea to the second-degree felony. Police reported Habib ran a red light and hit a pickup truck, knocking it off the road and into a ditch. The trucks driver, Chad L. Hayward, was killed, and two passengers in Habibs car were injured.

The value of construction put in place surged by 18.5% over 2006. Activity in civil engineering increased by 24.7% as a result of the construction of transport infrastructure. The construction of buildings grew by 15.5%; within that, non-residential construction was up 20.2%, whereas activity in residential construction decreased by 0.9%. Based on detailed data on issued building permits, the vigorous construction of hotels appears to have continued last year, probably along with the construction of wholesale and retail trade buildings. In interpreting the figure on the value of residential construction put in place we should bear in mind that these figures exclude the activity of smaller firms (see the note under the table), where the construction of buildings is the main activity. Stronger growth was partly linked to favourable weather conditions, especially in the first half of the year. This is corroborated by the business trends regarding the limiting factors in construction. The share of firms that reported bad weather conditions as a limiting factor was much lower in the first half of 2007 than in the previous year. The weather was also more propitious than the year before in the third quarter, but it was less favourable in the fourth quarter, which affected growth in the latter part of the year. The growth in the number of employees increased further last year. In 2007 the number of people employed in the construction sector was 11.3% higher, on average, than in 2006. The number of workers by activity rose particularly in building completion; in the latter part of the year it also increased in general construction. In terms of employee status, higher growth rates were recorded in the number of sole proprietors and their employees.

The number of planned dwellings and the total planned floor area of buildings continued to increase in the final quarter of 2006. The constant-dollar value of new construction put in place declined slightly in 1988 from the record set in 1987. (However, the 1988 current-dollar value of about $400 billion was a new record.) Small increases in public works construction were more than offset by declines in private construction. Although the number of housing starts fell 10 percent to 1.45 million units, the value of residential construction only decreased 2 percent because of a marked gain in average house size and an increase in home improvement spending. Public works construction increased slightly, led by strong spending for highways and schools. The lack of growth in private nonresidential construction was largely attributable to high vacancy rates for commercial buildings in most cities, as well as to the repeal of various tax benefits by the 1986 tax reform act. In 1988, the value of new construction put in place was equal to approximately 8.4 percent of gross national product (GNP). This represents a substantial recovery from the cyclical low of 7.7 percent of GNP in 1982, but is well below the post-World-War-Il peak of 11.9 percent attained in 1966. By this measure the construction share of GNP is expected to decline in 1989 (Figure 1-1). During the past decade, several types of construction activity that are not included in new construction data have grown rapidly. Within freight transport, railway transport rose substantially, while maritime transport dropped by a fifth. Transport of goods by railway surged by 14.9%, and the growth of road freight transport remained strong at 7%. The rapid expansion of land transport is explained by the robust domestic GDP growth and the high increase in harbour transport (10.6%). Roughly in the middle of 2006, the global growth of maritime transport eased off, which led to several quarterly decreases in the volume of this form of transport, including the first quarter of 2007, when the volume of Slovenian maritime transport fell by 19.9%. Over the past three years, the volume of road freight transport enjoyed the highest growth (by more than 50%) within freight transport (railway transport rose by 13.8%), while harbour and maritime transport rose by over 30%. Road freight transport is the main transport activity within the transport, storage, and communications sector, which has also seen the biggest expansion in the last few years. In 2006, the three main transport activities within the transport, storage, and communications sector were road freight transport, which employed 35.8% of workers in this sector, railway transport (15.2%), and the shipping industry (6.6%; both companies and sole proprietors are included, and the latter are also counted as employees). The corresponding shares of value added generated in these three branches are 23.3%, 12.0%, and 6.3%. Looking at the structure of workers employed in transport activities within the sector in 2003-2006, the highest increase of 3.2 p.p. was recorded in the share of road freight transport, while the shares of railway transport and shipping declined by 1.3 p.p. and 2.2 p.p., respectively (a similar direction and intensity of changes was also observed in the structure of value added; see graph). The number of employees in the transport segment of the transport, storage, and communications sector rose by 2,053 to 39,028. In 2006, road freight transport employed 18,807 workers, 2,425 more than in 2003. The number of workers in the forwarding industry fell by 950 to 3,445, while the number of railway workers declined by 326 to 7,985. The decline in the volume of the forwarding industry was largely caused by Slovenias entry to the EU. Data regarding both the volume of transport and the size of the activity are unfavourable in terms of sustainable development, since cargo is still largely being moved from railways to roads, rather than the other way around.

And Dyer can get to places few writers on music know exist - He was the opposite of his friend Art, who put everything of himself into everything he played: Chet put nothing of himself into his music and thats what lent his playing his pathos. The music he played felt abandoned by him.His friend Art - Id read that passage four times before I caught the pun, which Dyer may never have placed there. But the book is so driven by its need to get close to the art that sparked it you can find the like of that phrase all across it, hidden on any given page. Here there is no scene, only a music that begins in solipsism and refuses it. In Please Kill Me there is not even isolation, at least until the last pages. And yet all you had to do to prove that there is an irreducible music at the core of the book that denies the reality of inner lives was to catch Nikes Search and Destroy commercial during the Olympics: a montage of violent sports images running over a twenty-three-year-old Stooges song that the world outside of the one Please Kill Me describes hasnt begun to catch up with.
